M. Peter Adler is the president of AIPG LLC. His practice includes establishing administrative infrastructures in higher education entities to protect and manage information while complying with applicable state, federal, and international laws, regulations, and standards. Earlier this year he completed service as interim chief information security officer of the University of Colorado and is currently serving as the interim director of privacy and cybersecurity policy at Montgomery College, Maryland. He also provides counseling and advice on e-discovery, technology transfer, data mining, and data warehousing. Adler is a frequent lecturer and author on establishing infrastructure and business processes that lead to compliance with privacy, information security, and technology transfer laws and standards. He is a member of the District of Columbia Bar Association, IAPP, (ISC)2, EDUCAUSE, the Computer Security Institute, and the Information Systems Security Association.

Your host, Steve Worona, will be joined by M. Peter Adler, and the topic will be "Federal E-Discovery Rules—Hindrance or Opportunity?"

The Federal Rules of Civil Procedure were amended on December 1, 2006, to include new provisions on the discovery of electronically stored information (ESI). After providing a summary of these rules, this session will focus on steps that universities and colleges can take to manage ESI, including reasonable accessibility rules, privilege and waiver considerations, the duty to preserve electronic evidence, litigation holds, and the elements of an ESI retention and destruction program.
